These Terms of Service ("Terms") govern your purchase and use of Ophir DSP, a guitar amp and effects simulation plugin ("the Software") developed and sold by Dependent Developers, an individually-operated studio owned by Johan Sebastian Jimenez, based in Colombia ("we", "us", "our"). By purchasing or using the Software, you agree to these Terms.

1. The Product

Ophir DSP is a digital audio plugin (VST3 / AU) distributed electronically. There is no physical product. Checkout, payment processing, and order fulfillment are handled by Paddle.com Market Limited, our authorized reseller and Merchant of Record, who handles all sales, invoicing, and consumer transaction rights for orders on this site.

2. License Grant

Upon successful payment, we grant you a non-exclusive, non-transferable license to install and use the Software on devices you personally own or control, for as long as the Software exists, subject to these Terms. This is a one-time purchase — there are no recurring subscription fees for continued use of the version you purchased.

You may not resell, sublicense, rent, lease, or redistribute the Software or your license key.
You may not reverse-engineer, decompile, or attempt to extract the underlying models or source code, except where such restriction is prohibited by applicable law.
Your license key and any accompanying activation data are tied to your purchase and must not be shared publicly or used to activate the Software on devices you do not control.

3. Free Updates

Feature updates and bug fixes released for the version of the Software you purchased are provided at no additional cost. We do not guarantee updates will be released on any fixed schedule, and we reserve the right to discontinue support at our discretion, with reasonable notice where practical.

4. Payment & Taxes

All prices are shown in USD unless otherwise noted. Paddle, as Merchant of Record, calculates and collects any applicable sales tax, VAT, or similar transaction taxes at checkout based on your location.

5. Refunds

Refund requests are handled under our Refund Policy.

6. Disclaimer of Warranty

The Software is provided "as is". While we test each release, we do not guarantee the Software will be free of bugs, uninterrupted, or compatible with every system configuration. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability arising out of your purchase or use of the Software will not exceed the amount you paid for it. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Software after changes are posted constitutes acceptance of the revised Terms.

Estos Términos de Servicio ("Términos") rigen tu compra y uso de Ophir DSP, un plugin de simulación de amplificadores y efectos de guitarra ("el Software") desarrollado y vendido por Dependent Developers, un estudio operado individualmente por Johan Sebastian Jimenez, con sede en Colombia ("nosotros"). Al comprar o usar el Software, aceptas estos Términos.

1. El Producto

Ophir DSP es un plugin de audio digital (VST3 / AU) distribuido electrónicamente. No existe un producto físico. El checkout, el procesamiento de pagos y la entrega del pedido son gestionados por Paddle.com Market Limited, nuestro revendedor autorizado y Merchant of Record, quien se encarga de todas las ventas, facturación y derechos de transacción del consumidor para pedidos realizados en este sitio.

2. Licencia Otorgada

Tras un pago exitoso, te otorgamos una licencia no exclusiva e intransferible para instalar y usar el Software en dispositivos de tu propiedad o control, mientras el Software exista, sujeta a estos Términos. Se trata de una compra única — no hay cuotas de suscripción recurrentes para seguir usando la versión que compraste.

No puedes revender, sublicenciar, alquilar o redistribuir el Software ni tu clave de licencia.
No puedes realizar ingeniería inversa, descompilar ni intentar extraer los modelos o código fuente subyacentes, salvo donde dicha restricción esté prohibida por ley aplicable.
Tu clave de licencia y cualquier dato de activación asociado están vinculados a tu compra y no deben compartirse públicamente ni usarse para activar el Software en dispositivos que no controlas.

3. Actualizaciones Gratuitas

Las actualizaciones de funciones y correcciones de errores publicadas para la versión del Software que compraste se entregan sin costo adicional. No garantizamos que las actualizaciones se publiquen en un cronograma fijo, y nos reservamos el derecho de descontinuar el soporte a nuestra discreción, con aviso razonable cuando sea posible.

4. Pago e Impuestos

Todos los precios se muestran en USD salvo que se indique lo contrario. Paddle, como Merchant of Record, calcula y recauda cualquier impuesto de venta, IVA o impuesto de transacción similar aplicable durante el checkout según tu ubicación.

5. Reembolsos

Las solicitudes de reembolso se gestionan según nuestra Política de Reembolso.

6. Exención de Garantía

El Software se proporciona "tal cual". Aunque probamos cada versión, no garantizamos que el Software esté libre de errores, sea ininterrumpido o compatible con toda configuración de sistema. En la máxima medida permitida por la ley, renunciamos a todas las garantías, expresas o implícitas, incluida la idoneidad para un propósito particular.

7. Limitación de Responsabilidad

En la máxima medida permitida por la ley aplicable, nuestra responsabilidad total derivada de tu compra o uso del Software no excederá el monto que pagaste por él. No somos responsables de daños indirectos, incidentales o consecuentes, incluida la pérdida de ganancias o de datos.

8. Cambios a Estos Términos

Podemos actualizar estos Términos ocasionalmente. El uso continuado del Software después de publicados los cambios constituye la aceptación de los Términos revisados.
